Scope
This Privacy Policy describes how 1st Private Capital, Inc. ("we," "us," "our") handles information collected through this website, 1stprivatecapital.com, including the secure client portal, and through our app in ChatGPT, described below. It does not govern information you provide to us offline, by telephone, or through other channels operated by third parties.
Information You Provide
We collect the information you choose to give us through the forms on this site, such as:
- Your name and contact details, including email address and telephone number.
- Details of your inquiry, scenario, or proposed transaction, including property address, property value, requested loan amount, loan type, and any notes you add.
- Your stated relationship to us, such as borrower, broker, or capital partner.
- Documents and files you choose to upload inside the client portal.
- Messages you send to us through the portal.
Please do not submit Social Security numbers, full account numbers, or other government identification numbers through general contact or inquiry forms. When a loan file requires that information, we will tell you directly how to deliver it.
Our App in ChatGPT
We offer an app inside ChatGPT, a service operated by OpenAI, that prices loan scenarios and lets you request a term sheet. When you use it, we receive the scenario details you provide, such as property state, value, loan amount, property type, and approximate credit score, together with an anonymous conversation identifier supplied by ChatGPT. We keep a record of these pricing requests to operate and improve the service; it does not include your name or contact details.
If you choose to request a term sheet, we also receive your name, email address or telephone number, and the property address, and we handle them exactly as we handle an inquiry submitted through this website. We do not pull credit through the app. Your use of ChatGPT itself is governed by OpenAI's own terms and privacy policy.
Information Collected Automatically
When you submit an inquiry through this site, our server records the Internet Protocol (IP) address the submission came from and the browser user-agent string it reported. We use this narrow technical record to prevent abuse, apply rate limits, and investigate suspected fraudulent or automated submissions.
An inquiry also carries a short first-party record of your visit, described under Cookies and Similar Technologies below: the site or campaign link that brought you here, the pages on this site you viewed and when, and the page you sent the inquiry from. We use it to understand what you were looking for so we can respond to the right question, and to learn which of our pages and outreach efforts lead to inquiries. It is collected by this site alone and is not shared with advertisers or data brokers.
If you allow it, analytics and advertising technologies may also collect information about your visit automatically: the pages you view, the site or ad that brought you here, a random identifier for your browser, your approximate location from your IP address, and technical details of your device and browser. Which of these run, and for whom, is set by your choice in the cookie banner and the Cookie Settings panel. See Cookies and Similar Technologies below and the Cookie Policy.
Standard server and infrastructure logs may also record request metadata in the ordinary course of operating and securing the site.
Cookies and Similar Technologies
This site uses cookies and similar technologies in three categories. Strictly necessary items always run. Analytics and Advertising run only if you allow them, and you choose the first time you visit through a banner with equal Accept all, Reject non-essential and Manage choices options. - Strictly necessary. A first-party cookie (pc_consent) records your cookie choice for 12 months. Session storage holds an in-progress chat or request so your answers are not lost if you navigate away or reload the page, and is cleared when you close the browser tab. Local storage holds your signed-in session token while you are using the client portal, so you are not signed out on every page load. Local storage also holds a first-party visit record: the date you first arrived, the page you landed on, the referring site or campaign tags in the link you followed, a count of your visits, and the pages on this site you viewed. Nothing is sent from this record while you browse. It leaves your browser only when you submit an inquiry form or send a request through the chat, when it is attached to that inquiry. The record expires after 90 days without a visit.
- Analytics. If you allow it, Google Analytics may be used to measure how the site is used so we can improve it.
- Advertising and remarketing. If you allow it, Google Ads and Meta (Facebook and Instagram) tags may be used to show you 1st Private Capital on other sites after you visit and to measure whether an ad led to a request. Google's tags run under Google Consent Mode and are told "denied" for every purpose until you allow one.
You can change your choice at any time through the "Cookie Settings" link in the footer of every page, and you can block or delete cookies through your browser settings. Clearing site storage will discard a saved draft, sign you out of the portal, erase the visit record and reset your cookie choice.
Global Privacy Control. If your browser sends the Global Privacy Control signal, we treat it as a request to opt out of the sale or sharing of your personal information: advertising is switched off automatically, the site tells you the signal was honored, and you can still turn advertising on yourself in Cookie Settings if you want to.
How We Use Information
We use the information described above to:
- Respond to your inquiries and communicate with you about them.
- Evaluate, underwrite, originate, and service business-purpose loans secured by real estate.
- Verify identity and authority, and confirm information relevant to a transaction.
- Provide access to the client portal and show you only the transactions you are authorized to see.
- Operate, secure, monitor, and improve this website.
- Comply with applicable law and our own legal, audit, and recordkeeping obligations.
Sale or Sharing of Personal Information
We do not sell your personal information for money, and we do not disclose it to third parties for their own independent marketing purposes. If you allow the Advertising category, advertising companies such as Google and Meta collect information about your visit through their cookies and pixels so they can show you our ads on other sites. California law treats that as "sharing" personal information for cross-context behavioral advertising, even though no money changes hands. It happens only with your choice.
Do Not Sell or Share My Personal Information. To opt out, leave Advertising off in the banner, use the "Do Not Sell or Share My Personal Information" or "Cookie Settings" link in the footer of any page, or send the Global Privacy Control signal from your browser. We will not ask you to verify your identity or take any other step to opt out, and we will not ask you to opt back in for at least 12 months unless you open the settings yourself. How We Disclose Information
We disclose information only as needed to do the work, and only to these categories of recipients:
- Service providers. Hosting, infrastructure, database, authentication, email delivery, and document storage vendors that process information on our behalf under contract and are not permitted to use it for their own purposes.
- Transaction participants. Where a transaction requires it, parties such as title and escrow companies, insurers, appraisers, settlement agents, and legal counsel.
- Capital partners. Where a transaction is placed with a funding source, information is disclosed in accordance with the role-based limits described below.
- Professional advisors. Our attorneys, accountants, and auditors.
- Legal and safety. Where required by law, subpoena, regulation, or legal process, or where necessary to protect our rights, enforce our agreements, or prevent fraud or harm.
- Corporate transactions. In connection with a merger, acquisition, financing, or sale of assets, subject to the protections described in this policy.
Role-Based Access in the Client Portal
The client portal shows each signed-in user only the transactions to which their account has been granted access, and only the fields appropriate to their role. Capital partner accounts see anonymized opportunity detail and do not receive borrower identity or a full street address unless and until disclosure is authorized. Access to any individual transaction is controlled by an explicit authorization record, not by role alone.
Data Retention
We retain inquiry and transaction information for as long as needed to provide our services, and thereafter for the periods required by applicable law and by our lending, tax, audit, and recordkeeping obligations. Loan file records are generally retained substantially longer than website inquiries that do not become transactions.
Security
Information submitted through this site is encrypted in transit using Transport Layer Security. Portal access requires authentication, documents are made available through time-limited links, and access to transaction data is restricted to authorized accounts and personnel. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. See our security page for more detail.
Your Choices
You may decline to provide information, though some information is necessary for us to evaluate a transaction. You may ask us to correct information you have given us, request access to it, or ask that we delete it, and we will respond consistent with applicable law and our recordkeeping obligations. Depending on where you live, you may have additional rights regarding your personal information, including the right to appeal a decision we make about a request.
Marketing Communications
If we send you commercial email, you may opt out using the unsubscribe mechanism in the message or by contacting us. We will still send you transactional and relationship messages about a loan or inquiry you have with us.
Business-Purpose Lending
Our loans are made for business purposes and are secured by real estate. Information submitted in connection with a business-purpose transaction is handled as commercial information rather than consumer credit information. Nothing on this site is a commitment to lend, and all loans remain subject to underwriting and documentation.
Children's Privacy
This site is directed to real estate professionals and investors. It is not directed to children, and we do not knowingly collect personal information from anyone under 18. If you believe a child has given us information, contact us and we will delete it.
Links to Other Sites
This site links to third-party websites and services we do not control, including mapping and social media platforms. Their privacy practices are their own, and we encourage you to read their policies.
